“Apocalyptica” has to pay 45,000 Euros in damages for trademark infringement and naming rights before the Regional Court of Berlin to the group “Rammstein “.
For their album “Worlds Collide” from the year 2007, the Finnish cellist group Apocalyptica recorded with various guest musicians, including Till Lindemann, singer of the band “Rammstein “.
The album was then advertised by the line “featuring Rammstein”. This happened nationwide with ads in magazines, city light posters and stickers on recordings. Consent of the band “Rammstein” was not present.
This was settled by a proposal by the court, the parties agreed to the payment of 45,000 € as a reasonable royalty. The file number of the procedure is as follows: 16 O 570/08.

Do managers and bands suddenly not have anything to do with each other? Of course the band had something to do with it!
It really isn’t the band’s decision to this. It is the Management’s. So no one should blame the band if they are angry at this accusation.

I like Apocalyptica but regardless of fault, Rammsteins name should have never been on that album
It was not a bad move on Rammsteins part to ask for a small amount of compensation for use of their name where it was not supposed to be, especially since the damage had already been done.
No one messes with Till and the boys, there is no one in the world I would defend as quickly and as over zealously as R+

Well, im getting that feeling thats it’s neither of their faults, and more of the record companies fault. why whould have it tooken 4 years for rammstein to suddenly do something about it? I mean yeah, Apocalyptica did use Rammstein instead of Till, and i wouldnt think that RAMMSTEIN would be at the least offended, considering everything they have done together. I dont know, thats my opinion.

its not apocalypticas mistake, its rammsteins. they shouldve specified this earlier, plus. I wouldve jsut let it slide. this’ll cripple relations between these 2 bands, which have produced wonderful fruits before.

This is actually a little surprising. Considering the past that these two bands have with each other; what with the song covers and live performances together, you would think that Rammstein would let this one slide.
I hope this won’t effect future songs that they could do together.
